Terms and Conditions

1. Introduction
By using our website and purchasing products from Gaijin Guitars LTD, you agree to comply with and be bound by these terms and conditions.
 
2. Contract Formation
When you place an order, you are making an offer to purchase goods. Our acceptance of your order takes place when we dispatch the goods to you. The contract is formed at this point.
 
3. Pricing
All prices on our website are in GBP and are inclusive of shipping. Prices are subject to change without notice, but any price changes will not affect orders that have already been confirmed.
 
4. Shipping
We offer shipping to the UK only.

5. Delivery Times
We aim to process and dispatch orders as soon as possible. Please understand that this is a small independent business so we aim to dispatch goods within 3 working days. Delays due to third-party couriers are outside of our control.
 
6. Returns and Refunds
This return policy is for guitars purchased ONLINE only. We do not accept returns for guitars that have been viewed and inspected in person.

  • Returns: You have the right to return goods within 14 days of receiving them, in accordance with the Consumer Contracts Regulations. Goods must be returned in their original condition with all packaging intact.

  • Return Process: To initiate a return, please contact us within 14 days of receiving your order. We will provide a prepaid shipping label for the return. The cost of the return shipping will be deducted from the total refund amount.

  • Refunds: Once the returned goods are received and inspected, a refund will be processed to the original payment method. The refund will exclude the cost of the return shipping unless the product is damaged - this will be covered by couriers insurance.

  • Right to Refuse Returns: We reserve the right to refuse returns or refunds on products that have been tampered with, modified, or damaged by the user. This includes any alterations, adjustments, repairs, or physical damage not caused during shipping - this extends to, and is not limited to

 
- The guitar has been subject to any form of wear and tear in your possession or when return shipping. This includes chips, dings, scratches, adding stickers or writing on the item etc.The guitar has been subject to any form of wear and tear or damage during your possession, use, or return shipping. This includes, but is not limited to, chips, dings, scratches, dents, cracks, scuffs, alterations, modifications, adding stickers or writing, exposure to extreme temperatures or moisture, and any other form of damage or deterioration to the item.
- The item has been modified in any way, this includes pickup changes, replacement parts, removal of any original parts, soldering and de-soldering of any electrical components.
- The item is missing any components, accessories or packing that were included when the item was received. This includes, cases, tags, case candy, working parts such as tremolo arms or case keys, tools, certificates and any factory sealed bags etc.
- The item is returned without us being notified of your intention to return it.

Please note that Paypal/Credit Card companies no longer refund the transaction fees associated with the sale or return of any product. If purchasing using either of these methods be aware that the 3% transaction fee will be deducted from any refund that is issued (for any reason).

Please also note that trades/part-ex transactions are final, and we are not in any circumstances able to return a guitar that has been traded in or sold to us. A 'traded' guitar may however be returned to us within 14 days and swapped for a similar priced alternative. The customer is responsible for all related shipping charges in this instance.
 
7. Damaged or Defective Items
If your item arrives damaged or defective, please notify us within 48 hours of receiving your order.​

  • Photographs of Damage: In the event that the shipping box is damaged upon receipt, you must take photographs of the box before and during opening to help us validate any insurance claims we may need to make. These photos are required as part of our claims process with the courier or insurance provider. Failure to provide these photographs may result in the inability to process a claim and may result in no refund being issued.

 
8. Blemishes, Imperfections, and Used Items
All of our products are used, and as such, they may exhibit signs of wear, blemishes, or imperfections. We aim to be transparent about the condition of each item.

  • Disclosure of Imperfections: Any noticeable blemishes, scratches, or imperfections are disclosed and highlighted through detailed images in each product listing. These images form an integral part of the product description and sale, and by purchasing, you acknowledge that you have reviewed these images carefully. Please note, all items are sold as-is, and any imperfections shown in the images are considered part of the item’s condition.

  • Condition: Due to the nature of used items, they will not be in mint or perfect condition. If you have any concerns about the condition of a specific product, please contact us prior to purchase for further clarification.

9. Guitar Request Service

 

Request Submission and Pricing:

Customers may submit a request for a specific guitar via the online request form on our website. Once the guitar has been sourced, Gaijin Guitars will contact the customer with a price for the instrument.

  • Deposit and Order Confirmation: To proceed with the purchase, a non-refundable deposit of 25% of the agreed price must be paid. This deposit secures the order, and the guitar will be ordered once payment is received.

  • Quality Control and Setup: Upon arrival, the guitar will undergo a quality control inspection and a basic setup at Gaijin Guitars. The customer will be notified when the instrument is ready and provided with pictures of the guitar.

  • Final Payment and Shipment: After receiving the pictures, the customer will be required to pay the remaining balance of the agreed price. Upon receipt of the final payment, the guitar will be shipped to the customer.

  • Non-Completion or Cancellation: If the customer does not wish to proceed with the purchase after being notified of the guitar’s readiness, the 25% deposit will be retained by Gaijin Guitars. The guitar will then be listed for sale on our webstore.

  • Exclusion from Return Policy: Guitars purchased through the guitar request service are custom ordered and therefore are not subject to our standard return policy. All sales are final once the final payment is received and the guitar has been shipped.

10. Warranty
No warranty is implied or given, every instrument is bought on the understanding that it is a used item that has passed our quality control process, and is fully functional.

11. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal data.
 
12. Payment
We accept a variety of payment methods, including credit and debit cards, and PayPal. Payment is processed at the time of purchase.
 
13. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales.

14. Changes to Terms
We reserve the right to update or amend these terms and conditions at any time. All changes will be posted on this page and are effective immediately upon publication.
